Understanding Your Home Improvement Contract in New York

By Cristian Poblete, Licensed Contractor WC-34542-H21 · Ossining, NY · Updated June 2026

New York State has specific requirements for home improvement contracts — and knowing what should be in yours protects you from some of the most common contractor disputes.

What New York Law Requires

Under New York State General Business Law Article 36-A, all home improvement contracts over $500 must be in writing and include:

What a Good Contract Also Includes

Beyond the legal minimum, a professional contractor's contract should specify:

Change Orders: The Most Common Dispute Area

Change orders are modifications to the original scope. They should always be in writing, signed by both parties, with the additional cost specified before work begins. Verbal change order agreements are difficult to enforce and are the source of most contractor-homeowner disputes in Westchester.

Our practice: We provide all change orders in writing with the price spelled out before any additional work starts. You sign, we work. No surprises.

Lien Waiver

Ask for a lien waiver when you make your final payment. This document confirms the contractor has been paid in full and waives their right to place a mechanic's lien on your property. It protects you from situations where a subcontractor wasn't paid by the general contractor and tries to lien your home.

What to Expect When You Work With Us

Every project starts with a free, no-obligation estimate done in person. We assess the work, discuss your goals and budget, and provide an itemized written quote. Once you decide to move forward, we handle everything: permits where required, material ordering, scheduling, the work itself, and cleanup. You get clear communication throughout — you always know what's happening and when. We pull permits properly, carry full insurance, and provide written contracts on every project.

Our reputation in this community is built on doing what we say we'll do. Cristian Poblete is personally involved in every project, managing quality and communication directly rather than handing your job off to a crew you've never met. That's why so many of our customers call us back for their next project and refer us to their neighbors.

Licensed, Insured, and Local

Westchester Home Improvements holds Westchester County Home Improvement Contractor License WC-34542-H21, verifiable through the county Department of Consumer Protection. We carry current general liability and workers' compensation insurance, with certificates provided to every customer before work begins. Being properly licensed and insured isn't just a formality — it's your protection if anything goes wrong, and it's the baseline difference between a professional contractor and a risk.
